01 Agreement
These Terms of Service ("Terms") govern your access to and use of Make It Shot (makeitshot.ai), operated by Make It Shot LLC. By accessing or using the service you agree to be bound by these Terms and our Privacy Policy.
02 Eligibility
You must be at least 18 years old to use the service and have the legal capacity to enter into binding agreements. By using Make It Shot you represent and warrant that you meet these requirements.
03 Accounts & access
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at info@makeitshot.ai if you suspect unauthorized access.
04 License & user content
You retain ownership of content you upload or create. By using the service you grant Make It Shot a limited, worldwide, royalty‑free license to host, store, display and transmit your content as necessary to operate and improve the service (including anonymized/aggregated model improvement) as described in our Privacy Policy.
You are responsible for ensuring you have all rights necessary for any content you upload, including third‑party materials.
05 AI models, third‑party providers & output
Make It Shot uses third‑party and/or in‑house AI models. Different models may have different usage restrictions and quality characteristics. You are responsible for complying with the terms of applicable model providers.
We do not guarantee outputs and are not liable for user actions taken based on generated content.
06 Commercial use
Generated content may be used commercially unless restricted by a third‑party model provider. You must verify licensing restrictions from the underlying provider before any commercial use or publication.
07 Prohibited uses
You must not use the service to create, distribute or publish content that is:
- Illegal under applicable law
- Infringing of third‑party intellectual property rights
- Defamatory, harassing or threatening
- Pornographic involving minors (strictly prohibited)
- Hateful, violent or discriminatory
- Otherwise prohibited by provider or platform policy
Violations may result in immediate account suspension or termination and reporting to relevant authorities.
08 Payments, credits & refunds
The service uses subscription plans and a credit system for generation features. Billing details, credit expiry rules and refund policies are described in your account and in‑app billing pages. Failure to pay may result in service suspension.
09 Suspension & termination
We may suspend or terminate accounts for violations of these Terms or for legal reasons with or without notice. You may terminate your account at any time via account settings. Certain data may be retained for legal or operational reasons after termination.
10 Indemnity
You agree to indemnify, defend and hold harmless Make It Shot LLC and its affiliates, officers and employees from and against any claims, damages, costs and liabilities arising out of your use of the service, violation of these Terms, or infringement by your content.
11 Limitation of liability & disclaimers
The service is provided "as is" without warranties of any kind. To the maximum extent permitted by applicable law, Make It Shot's aggregate liability is limited to the fees you paid in the 12 months preceding a claim (where applicable). We are not liable for indirect, incidental, consequential or punitive damages.
12 Governing law & disputes
These Terms are governed by the laws of the State of Illinois, United States. Disputes shall be subject to the courts of Illinois, to the extent permitted by applicable law.
13 Changes to these Terms
We may update these Terms. Material changes will be communicated (e.g., by email or in‑app notice). Continued use of the service after changes constitutes acceptance of the revised Terms.
